III. Processing of personal data
1. GENERAL INFORMATION AND MANDATORY INFORMATION
Data protection
The operator of these pages (hereinafter “JOOP! LIVING”) takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations as well as this privacy policy. When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains which data we collect and what we use it for. It also explains how and for what purpose this happens. We would like to point out that data transmission over the internet (e.g. communication via e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.
1.1 Note on the controller
The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. An informal message by e-mail (customercare@joop-living.com) to us is sufficient for this. The legality of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS OR THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).
1.2 Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.
1.3 Right to data portability
You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to yourself or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place if it is technically feasible.
1.4 Access, deletion and correction
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time at the address provided in the imprint for this purpose or for further questions on the subject of personal data.
1.5 Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time at the address provided in the imprint. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the audit, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
- If you have filed an objection pursuant to Art. 21 Para. 1 GDPR, a balance must be struck between your interests and ours. As long as it is not yet certain whose interests prevail, you have the right to request the restriction of the processing of your personal data.
- If you have restricted the processing of your personal data, these data may – apart from their storage – only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.
2. DATA COLLECTION ON THIS WEBSITE – TYPE, PURPOSE AND LEGAL BASIS
When using our website for purely informational purposes, i.e. simply by visiting our website www.joop-living.com, information is automatically sent to our website's server by the browser used on your device due to technical necessity. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automated deletion:

- Date and time of access,
- Name and URL of the retrieved file,
- Website from which access is made (referrer URL),

The data mentioned are processed by us for the following purposes:
- Ensuring a smooth connection of the website,

- Evaluation of system security and stability, and
- For further administrative purposes (e.g. threat prevention and support in case of connection problems)
The information is stored for security reasons (e.g. to clarify abuse or attacks on our web server) for the time required for this purpose (usually a few days; in the case of targeted attack or abuse detection, up to several weeks). After that, they are deleted.
The legal basis for this data processing is Art. 6 Para. 1 S. 1 lit. f GDPR. Our legitimate interest follows from the purposes for data processing listed above. A merging of this data with other data sources for the purpose of creating user profiles does not take place.
2.1 Cookies
Our websites use so-called "cookies". Cookies are small text files and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.
In some cases, cookies from third-party companies can also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services). Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or to display advertising.
Cookies that are required for carrying out the electronic communication process (necessary cookies), for providing certain functions desired by you (functional cookies, e.g. for the shopping cart function), or for optimizing the website (e.g. cookies for measuring the web audience) are stored on the basis of Art. 6 Para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the relevant cookies are stored exclusively on the basis of this consent (Art. 6 Para. 1 lit. a GDPR); consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when closing the browser. The functionality of this website may be limited if cookies are deactivated. Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you about this separately within the framework of this privacy policy and, if necessary, request consent.
2.2 Inquiry by e-mail or telephone
If you contact us by e-mail or telephone, your request, including all personal data resulting from it (name, request), will be stored and processed by us for the purpose of processing your concern. We do not pass on this data without your consent.
The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, provided that your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR) if this has been requested.
The data you send to us via contact inquiries remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular statutory retention periods – remain unaffected.
3. SOCIAL MEDIA
3.1 Social media plugins with Shariff
Plugins from social media (e.g. Facebook, Instagram) are used on this website.
You can usually recognize the plugins by the respective social media logos. To ensure data protection on this website, we only use these plugins together with the so-called "Shariff" solution. This application prevents the plugins integrated on this website from transmitting data to the respective provider the moment you first enter the page.
A direct connection to the provider's server is only established when you activate the respective plugin by clicking on the corresponding button (consent). As soon as you activate the plugin, the respective provider receives the information that you have visited this website with your IP address.
If you are logged into your respective social media account (e.g. Facebook) at the same time, the respective provider can assign your visit to this website to your user account. Activating the plugin constitutes consent within the meaning of Art. 6 Para. 1 lit. a GDPR. You can revoke this consent at any time with effect for the future.
3.2 Facebook Plugins (Like & Share button)
Plugins from the social network Facebook are integrated into this website. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the data collected is also transferred to the USA and other third countries.
Meta Platforms, Inc. (USA) is certified under the U.S. Data Privacy Framework (adequacy decision of the EU Commission of 10.07.2023, Art. 45 GDPR.
You can recognize the Facebook plugins by the Facebook logo. An overview of the Facebook plugins can be found here:
https://developers.facebook.com/docs/plugins/?locale=de_DE
Only when you actively click the Facebook button is a direct connection established between your browser and the Meta server, in accordance with the Shariff solution described in clause 3.1. Meta thereby receives the information that you have visited this website with your IP address.
If you click the Facebook "Like button" while you are logged into your Facebook account, you can link the contents of this website to your Facebook profile. This allows Facebook to assign your visit to this website to your user account.
We point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook. Further information on this can be found in Facebook's privacy policy at:
https://de-de.facebook.com/privacy/explanation.
If you do not want Facebook to be able to associate your visit to this website with your Facebook user account, please log out of your Facebook user account. The transmission of your data to Meta takes place – as described in clause 3.1 – only after you have activated the plugin and is based on your consent in accordance with Art. 6 Para. 1 lit. a GDPR. Consent can be revoked at any time with effect for the
future.
3.3 Instagram Plugin
Functions of the Instagram service are integrated into this website. These functions are offered by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (with forwarding to Meta Platforms, Inc. USA).
As described in clause 3.1, a connection to Meta's servers is only established after you actively click the plugin. With regard to data transfer to the USA, clause 3.2 applies accordingly.
If you are logged into your Instagram account, you can link the contents of this website to your Instagram profile by clicking the Instagram button. This allows Instagram to assign your visit to this website to your user account. We point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram.
The transmission of your data takes place – as described above – based on your consent in accordance with Art. 6 Para. 1 lit. a GDPR. Consent can be revoked at any time with effect for the future.
Further information on this can be found in Instagram's privacy policy:
https://instagram.com/about/legal/privacy/
3.4 Data security
To secure your data, we use the widespread SSL (Secure Socket Layer) method during your website visit in conjunction with the highest level of encryption supported by your browser. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether an individual page of our website is transmitted in encrypted form can be recognized by the closed representation of the key or lock symbol in the bottom status bar of your browser.
4. Hosting by Shopify (Processing on behalf)
This website is operated on the platform of Shopify International Limited, 2nd Floor, 1 Grand Canal Square, Dublin 2, Ireland (hereinafter “Shopify”). On our behalf, Shopify collects and processes IP addresses, device and browser information, as well as all customer, order, and payment data generated during the order process, acting as a data processor in accordance with Art. 28 GDPR, in order to ensure the technical operation, security, and order processing of our shop. The legal basis is Art. 6 (1) lit. b and lit. f GDPR.
Further information on data processing by Shopify as well as options to object to certain types of processing (including in the context of so-called “Enhanced Services”) can be found at https://privacy.shopify.com
Insofar as Shopify’s own additional functions are used without separate third-party providers (e.g., native checkout extensions or internal automation workflows), no processing by an additional recipient takes place; such processing is carried out within the scope of the data processing by Shopify described above.
5. Third-party applications used (Shopify Apps)
To provide individual additional functions, we use the following applications obtained via the Shopify App Store, which access personal data to the extent specified in each case. We have concluded contracts pursuant to Art. 28 GDPR with providers acting as data processors, or will do so before commissioning: for providers based outside the EU/EEA, we base the transfer on EU Standard Contractual Clauses (Art. 46 (2) lit. c GDPR) if no adequacy decision exists.
